GENERAL TERMS AND CONDITIONS OF SALE
Preamble
These General Terms and Conditions of Sale (GTC) govern the contractual relationship between:
CART-CITY, a sole proprietorship (autónomo) registered under NIF number Y2194750N, located at:
Calle Ponent, 87
43820 Calafell
Spain
and operating the e-commerce website: https://shop.cart-city.com
Hereinafter referred to as “the Website”.
And:
Any natural or legal person wishing to make a purchase via the Website, hereinafter referred to as “the Customer”.
The purpose of these terms is to define the rights and obligations of the parties in connection with the online sale of products offered by CART-CITY.
Acceptance of Terms
Any order placed on the Website implies full and unreserved acceptance of these General Terms and Conditions of Sale.
The Customer acknowledges having read these terms before confirming their order and declares to accept them without reservation.
The Customer also declares to have the legal capacity to enter into a contract.
Duration and Modification
These terms apply for the entire duration that the services offered by the Website are online.
CART-CITY reserves the right to modify these GTC at any time.
The applicable terms are those in force on the date of the order.
Order
Orders are placed directly on the website: https://shop.cart-city.com
To place an order, the Customer selects the desired products and adds them to their shopping basket.
Before confirming the order, the Customer can check its details, its total price, and correct any errors.
The order becomes final after:
- shopping basket validation
- order confirmation
- payment of the corresponding price
An order confirmation is then sent to the Customer by email.
CART-CITY reserves the right to refuse or cancel any order in case of an existing dispute with the Customer or in case of non-payment of a previous order.
Product Information
The essential characteristics of the products are presented on the product pages of the website.
Photographs and descriptions are provided for informational purposes only and are not contractually binding.
Product Availability
Products are offered within the limits of available stock.
In case of unavailability of a product after an order has been confirmed, the Customer will be informed as soon as possible.
The Customer may then choose:
- a delayed delivery
- an equivalent product
- a refund for the product concerned
- order cancellation
Price
Prices are indicated in Euros (€).
Some prices displayed on the website may be indicative (“starting from”) and depend notably on:
- quantities ordered
- chosen options
- delivery location
The exact price will be indicated during the final order confirmation.
VAT
Prices are indicated in Euros (€).
For customers located in Spain, VAT is applied at the current rate (21%).
For businesses located in the European Union with a valid intra-community VAT number, invoicing may be carried out without VAT, in accordance with the VAT reverse charge mechanism.
In this case, VAT is due by the Customer in their country of establishment in accordance with applicable tax regulations.
The Customer’s intra-community VAT number can be verified via the European VIES system.
For customers located outside the European Union, sales are made without VAT.
In certain specific cases, some operations may be subject to the VAT reverse charge mechanism by the Customer, in accordance with applicable tax legislation.
Invoices may include the corresponding legal notice, notably:
“VAT reverse charge – Article 194 of Directive 2006/112/EC”
or
“Inversión del sujeto pasivo – art. 6.1.m del Real Decreto 1619/2012”
Payment
Payment for orders is made in Euros (€).
The payment methods accepted on the website are:
- credit card
- bank transfer
- PayPal
When paying by credit card, the order amount is debited at the time of transaction validation.
When paying by bank transfer, the order is registered after the Customer confirms the order. It will be processed upon effective receipt of payment in CART-CITY’s bank account.
CART-CITY reserves the right to suspend or cancel any order in case of payment refusal by the financial institutions concerned.
An invoice is sent to the Customer electronically.
Products remain the property of CART-CITY until full payment of the order price.
Delivery
Products are delivered to the address indicated by the Customer when placing the order.
CART-CITY delivers its products in Europe and internationally.
Delivery costs are specified before order confirmation or on the quote.
Delivery times are indicative and expressed in working days.
A delay in delivery cannot give rise to damages.
Receipt of Goods
The Customer is required to check the condition of packages and products upon delivery.
In case of an anomaly (missing product, damaged package, defective product), the Customer must make reservations with the carrier and inform CART-CITY within 3 days.
After this period, the products will be deemed compliant.
Returns and Claims
All returns must be subject to prior authorization from CART-CITY.
If a return is accepted, products may be reshipped directly to the production site or the logistics warehouse of CART-CITY’s partner manufacturer.
The return address and shipping instructions will be communicated to the Customer at the time of return authorization.
Returned products must be in their original condition, unused, and in their original packaging.
Depending on the nature of the return (withdrawal, order error, non-compliant product, or defect found), return costs may be borne by the Customer, unless otherwise provided by law or specific agreement from CART-CITY.
CART-CITY reserves the right to indicate the most appropriate logistics solution for product returns to optimize transport conditions.
Bulky products or those requiring specific transport may be subject to particular return conditions.
Limitation of Returns
Given the professional nature of the products offered by CART-CITY, returns are only accepted in the following cases:
- product not conforming to the order
- defective product
- error attributable to CART-CITY
Returns motivated by a Customer’s order error or a change of mind may be accepted exceptionally, subject to prior agreement from CART-CITY.
In this case, return, transport, and potentially restocking fees may be entirely at the Customer’s expense.
CART-CITY reserves the right to refuse a return when the return conditions are not met or when the products are no longer in their original condition.
Products manufactured or specially ordered for the Customer cannot be returned or exchanged.
Right of Withdrawal
In accordance with applicable European legislation, the Customer has a period of 14 days from receipt of the products to exercise their right of withdrawal.
Return costs remain at the Customer’s expense.
The refund will be made within a maximum of 14 days after receipt of the returned products.
Warranty
Products offered by CART-CITY benefit from a 2-year warranty against manufacturing defects.
In case of a proven defect, CART-CITY may proceed with:
- product replacement
- or refund
CART-CITY cannot be held responsible for improper use of the products.
Product Use
Products marketed by CART-CITY are intended for professional use in retail businesses and establishments open to the public.
The Customer is responsible for using the products in accordance with their intended purpose and applicable safety regulations.
CART-CITY cannot be held responsible for damages resulting from non-compliant or inappropriate use of the products.
Force Majeure
CART-CITY cannot be held responsible in case of force majeure preventing the execution of the contract.
Cases of force majeure notably include:
- strikes
- natural disasters
- transport interruptions
- government decisions
- network or infrastructure failures
Disputes and Applicable Law
These GTC are subject to Spanish law.
In case of a dispute, the parties will endeavor to find an amicable solution.
Failing this, the competent courts will be those within the jurisdiction of CART-CITY’s headquarters.
Intellectual Property
All elements of the website (texts, images, graphics, logos, etc.) are protected by intellectual property law.
Any reproduction or use without prior written authorization from CART-CITY is strictly prohibited.
Personal Data Protection
Personal data collected on the Website is used solely for order processing and commercial relations.
